DEPARTMENT OF THEORY AND HISTORY OF STATE AND LAW, CONSTITUTIONAL AND ADMINISTRATIVE LAW OF THE LAW FACULTY AL-FARABI KAZNU

 

 

 


 

  • Department of Theory and History of State and Law, Constitutional and Administrative Law was founded in 2011 in order to implement the Development Strategy of the Al-Farabi Kazakh National University.

  • The basis of the Department was Department of Theory and History of State and Law and Department of Constitutional and Administrative Law, which have a rich history and traditions.

 


 

 

Department of Theory and History of State and Law was established in 1938 with the formation of the Almaty State Law Institute (ASLI). The first head of the Department was Associate Professor N.I. Kondratieva. The Department was represented by five lecturers. In the 40–s of the XX century at the Department well-known scientists, such as Academician S.V. Yushkov; Professors A.H. Stalgevich, S.L. Fuks; Associate Professors L.V. Dyukov, T.M. Kulteleev worked there. Academicians S.V. Yushkov and Professor S.L. Fuks played a major role in the development of legal education in Kazakhstan.


  • In April 1940, Director of ASLI was Candidate of Law, Associate Professor Kulteleev Tair Muldagalievich, at that time he was 27 years old.

He was the first Kazakh lawyer who defended his thesis on Customary Law of the Kazakhs at the Academic Council of the Leningrad Law Institute in 1939.

  • From 1945 to 1950 the Department was headed by Candidate of Law, Associate Professor Dyukov L.V.

Leonid Vasilyevich moved to Alma-Ata at a young age and devoted his whole life to Al-Farabi Kazakh National University and legal education of Kazakhstan.

  • Since 1960 the Department was headed by Zhakipova Aspasia Jakipovna. She became the first female Kazakh who received the scientific degree of Candidate of law. Her research interest was Family Customary Law of Kazakhs.
  • Since 1965, the Department was headed by Candidate of Law, Associate Professor Taukelev Aidarat Nurekelovich.

He was a recognized scientist in the field of history of political and legal doctrines; his versatile knowledge in all areas of law earned him the deserved respect among all lawyers of Kazakhstan.

 
  • Since the beginning of 50-s of the XX century the Academician of NAS RK, Candidate of Law. Professor Sartaev Sultan Sartaevich has worked in the department.

In 1990 S.S. Sartaev was appointed a member of the first and the only Presidential Council in the Republic. In this position, he has done a lot for Kazakhstan. As a public official, he was one of the first person who raised the issue of the status of the national language. S.S. Sartaev was elected Deputy of the 12th and 13th convocations of the Supreme Soviet of the Republic of Kazakhstan. Sultan Sartaevich remains faithful to the legal education and Law Faculty of Al-Farabi Kazakh National University, where he has worked for more than 50 years. S.S. Sartaev was awarded with the Order of "Badge of Honor" and the Order of "Parasat" (December 10, 2001) for his active scientific-pedagogical and socio-political activity. More than fifty years S.S. Sartaev is the permanent Chairman of the Dissertation Council for doctoral theses at Al-Farabi KazNU. He created his own scientific school. Today pupils of S.S. Sartaev work in the field of legal science, legal education and law enforcement. He has trained five Doctors of Law and more than forty Candidates of Law; currently he is the Professor and Honorary Head of the Department.

 
  • From 1994 to 1997 the Department was headed by Candidate of Law, Associate Professor Voitsehovski E.I.

He was a recognized expert in the field of General History of the State and Law.

  • From May 1997 to September 2008 the Department was headed by Doctor of Law, Professor Ibrayeva Alua Salamatovna.

A.S. Ibrayeva is the author of more than 100 scientific works. In 2006 Ibrayeva A.S. became the owner of the State grant "The Best Teacher of Higher School".

 
  •  Department of Constitutional and Administrative Law has a rich history and traditions. It was founded in 1958 on the basis of the former Alma-Ata Law Institute and was called Department of State Law and Soviet Construction.
  • From September 2008 to 2011 the Department was headed by Ph.D., Professor Nezdemkovsky Viktor Vasilyevich.

He is a specialist in the History of the State and Law of Foreign Countries, he is the author of more than 30 scientific works.

  • From 1958 to 1982 Department of State Law and Soviet Construction was headed by Doctor of Law, Professor Kotov Konstantin Flegontovich.

In 1950 he graduated from the post-graduate school of Almaty State Law Institute and a year later he defended his thesis on “The Foundation of the Soviet State Apparatus of Kazakhstan (1920-1936)”. Since then, his life has been closely connected with the Law Faculty of the S.M. Kirov Kazakh State University. In 1962 he defended his doctoral thesis on the topic: “The Essence of the Local National Autonomy in the People's Republic of China: the Basic Problems of the Theory and Practice of Nation-Building in China on the Example of the Xinjiang Uygur Autonomous Region in 1949-1957.”. Under his leadership, 20 doctoral theses were defended.

  • In the period of 1962-1965 the Department was headed by Doctor of law, Professor Belson Yakov Mikhailovich who graduated from Kalinin Leningrad Institute of Law (1945-1945).

In 1951 he defended his thesis on the topic: “The Highest Permanent Public Authorities in the Countries of People's Democracy”. Doctoral dissertation on the topic: “The Main Problems of the State and Legal Science of Great Britain and the United States” was defended in 1962 in Moscow. He has published more than 100 scientific papers.

  • Since 1982 the Department was headed by Doctor of Law, Professor Kim Vladimir Alexandrovich.

Kim V.A. was born on January 22, 1923 in Nakhodka, Primorsky Krai, Russia. After graduating from the Almaty branch of All-Union Legal Correspondence Institute he worked as a teacher at Alma-Ata School of Law. In 1952 he graduated from the postgraduate school of Institute of State and Law of the USSR Academy of Sciences with the defense of the candidate's dissertation on “State System of North Korea”. From 1952 to February 1957 he worked as a senior researcher in the Philosophy and Law Sector of the Academy of Sciences of Kazakh SSR. And from March 1957 to July 1970. He was the head of the Department of State Sciences of the Institute of Philosophy and Law of the Academy of Sciences of Kazakh SSR. In 1963 he defended his doctoral dissertation "The Role of the People's Democratic State and Law in the Socialist Transformation of Agriculture” at the Institute of State and Law of the USSR Academy of Sciences (Moscow). In 1964, the USSR Academy of Sciences he was awarded the title of Professor. Since 1970 he was appointed Deputy Chief of Karaganda Higher School of Militia of the Ministry of Internal Affairs of the USSR, where he was awarded the title of Colonel. Since 1982, he began to head the Department of State (Constitutional) Law at the S.M. Kirov Kazakh State University, where he worked until 1999. Currently Kim V.A. is the Honorary Head of the Department. In 1996, Doctor of Law, Professor Kim V.A. was elected a full member of the Academy of Humanities of the Republic of Kazakhstan and a foreign member of the Russian Academy of Natural Sciences. The manifestation of tireless work of Vladimir Alexandrovich is training young scientists-lawyers of the Republic. For many years Vladimir Alexandrovich is a member of the dissertation Council of Al-Farabi Kazakh National University on defense of doctoral and candidate dissertations. He is devoted to Al-Farabi Kazakh NU, the flagship of science and higher education. Tireless scientific socio-political energy of Vladimir Alexandrovich continues in active participation in the development and examination of the most important laws of the Republic.

  • In 1991-1993 the head of the department was Doctor of Law, Professor Kopabaev Omraly Kazhibaevich.

After graduating school in the Taldykorgan region in 1967, he entered the Ministry of Internal Affairs of the Kazakh SSR. For outstanding service, he is enrolled in the Law Faculty of S.M. Kirov Kazakh State University. Kopabaev O.K. graduated Kazakh National University as one of the best graduates of the university and entered the post-graduate course. Under the supervision of Professor Sartaev S.S., he defended his candidateship thesis on the topic “Interaction of the Executive Committees of the Regional Council with Subordinate Enterprises” and became the Corresponding Member of the Academy of Sciences of the Republic of Kazakhstan. In 2000, he defended his doctoral dissertation on the topic "Organization and Constitutional and legal bases of the Government of the Republic of Kazakhstan” (problems of theory and practice)". Under his supervision, 3 candidate dissertations were defended. There are more than 100 his scientific works and articles in Kazakh and Russian languages ​​published both in our country and abroad.

 

In 1995, during the year the Department was headed by Candidate of Law, Associate Professor Mamonov Vladimir Vasilyevich.

From September 1967 he worked at Department of State Law of the Kazakh State University as an assistant, and since October 1971 – as a senior lecturer of Department of State Law and Soviet Construction, since January 1975 – he was the Associate Professor of the same Department, then of the Department of Constitutional Law, Constitutional and Administrative Law. From September 1995 to April 1996 he was the head of the Department of Constitutional and Administrative Law of Al-Farabi KazSNU.


  • Since 1999 to 2001 the Department was headed by Candidate of Law, Associate Professor Akhmetov Mizami Mustakhimovich.

Akhmetov M.M. graduated from Law Faculty of Kazakh State University in 1981. In 1986 he entered the graduate school of full-time education at the Law Faculty of Kazakh State University, then in 1999 he defended his thesis on “Formation of the Executive Branch in Modern Conditions of Democratization of Society.”

  • From 2002 to 2011, the Department was headed by Doctor of Law, Professor Kenzhaliev Zailagi Zhantuganovich.

In 1981 he graduated from Law Faculty of S.M. Kirov Kazakh State University. He began his work experience at Institute of State and Law of the Academy of Sciences of Kazakhstan as a junior researcher. Then he held positions of the researcher, the senior researcher, the head of Department, the Deputy Director for science of this Institute. From 1995 to 1997 he worked as the first Vice-Rector of the Kazakh Academic University. Since September 2002 he was the head of Department of Constitutional and Administrative Law. Kenzhaliev Z.Z. is the Deputy Chairman of the Dissertation Council on protection of dissertations, specialty 12.00.01.

  • From 2011 to April 2021, the Department of Theory and History of State and Law, Constitutional and Administrative Law was headed by Doctor of Law, Professor Useinova Gulnara Rakhimzhanovna.


Graduated from the Faculty of Law of the Kazakh State University named after S.M. Kirov in 1989. From 1989 to 1991, trainee researcher of the Department of Theory and History of State and Law, 1991 to 1993 - postgraduate studies. 1993 - Assistant of the Department of Theory and History of State and Law. 1997 - Senior lecturer of the department. Since 1999 – Associate Professor of the Department of Theory and History of State and Law; Deputy Dean for Science and Master's Degree. From 2009 to 2011 - Deputy Dean for Academic Affairs.

Doctor of Law, Professor Useinova G.R. in 1996 defended her PhD thesis on the topic "State and legal views of Ch.Ch. Valikhanov". In 2009 she defended her doctoral dissertation on: "State-legal views of A.N. Bukeikhanov".

  • From May 2021 to September 2022, the Department of Theory and History of State and Law, Constitutional and Administrative Law was headed by Professor Kenzhaliev Zailagi Zhantuganovich.
  • Since September 2022, the department is headed by Doctor of Law, Professor Alua Salamatovna Ibrayeva.

A. S. Ibraeva is the author of more than 200 scientific papers. In 2006, Ibraeva A. S. was awarded the state grant "Best university teacher".

In the 2014-2015 academic year Professor of Dagestan State University M.A. Ismailov and Columbia University Professor Abazov R.F. were invited to the Department. Currently academic degree holders rate at the Department – more than 80%. The indicator of high qualification of the staff of the Department is that the majority of the members of the Department have state awards and scholarships, for example, the winner of the state award – the order "Kurmet" – 1, the winner of the state award – the order "Barys" of the 3rd degree – 1, the owner of the state scientific grant for scientists and experts who have made outstanding contributions to the development of science and technology of Kazakhstan – 1, member of the Academy of Sciences – 1, the owners of the grant "Best Teacher of the HEI" - 7, laureates of the state scientific grant for talented young scientists – 4.

From 2011 to the present, all disciplines of the department are taught using a problem-oriented, personality-oriented approach, as well as using a project-organized approach in the educational process.

From 2003 to the present, members of the Department have been actively involved in the implementation of fundamental scientific research through the Ministry of Education and Science of the Republic of Kazakhstan.

 

Contractual R&D:

1) “Improvement of the educational process higher educational institutions in the field of the development of protection, conservation and safeguarding of the rights and freedoms of vulnerable segments of population” in the framework of the Program of “Micro projects on legal education” under the program of “Equality before the law: access to justice in Central Asia " (Eurasia Foundation with the support of the Ministry of Justice of Finland).

2) “Theoretical and legal justification of the need to improve the Constitutional and legal status of vulnerable segments of population". Actualization of the problems of social and legal protection of the population in the educational process under the program "Equality before the law: access to justice in Central Asia" (Eurasia Foundation with the support of the Ministry of Justice of Finland).

3) The Concept of the priority of universal values in the system of legal regulation of road transport relations in the framework of the transport policy development of the transport infrastructure of Kazakhstan.

4) “Formation of legal culture in the context of the establishment of the rule of law and the development of civil society."

 

The main directions of the research work of the Department over many years is the study of problems of the development of Kazakhstan's statehood, the theory of state and law, history of state and law, history of legal and political doctrines, the study of problems of the formation and development of Constitutional and administrative law, the study of problems of formation and development of the Constitutional law of foreign countries, research of problems of the development of international law in Kazakhstan, study of problems of ensuring and protecting the rights and freedoms of a man and a citizen, participation in the development and solution of the problems of the theory and practice of real interaction of executive and representative bodies. As a result, a number of monographs, more than two hundred brochures were written and published. Some proposals of the Department are reflected in the activities of the Central executive authorities. Scientific conferences and round tables are held with the support of the University.

 

Also, in the Department there is the Scientific Research Centre of the system of local self-government under the leadership of Doctor of Law, Professor Baymahanova D.M.

Lecturers of the Department actively publish the results of their research in international scientific journals included in the Scopus database, Thomson Reuters, in Kazakhstan publications on the recommended list of KKSON MES RK, publications and materials of international conferences, materials of international and national conferences of the Republic of Kazakhstan.

Lecturers of the Department carry out management of scientific reports of students and undergraduates who took part in the annual traditional international Congress of students and young scientists “World of Science”.

 

The Department has scientific student clubs and clubs. "Union for progress", which operates from 2013-2014 academic year was recognized as the "Best Student Club of the University." Also, the Department conducts educational work with students in student clubs: the "Sanaly Urpaq", "Amanat", "Zimanov’s Small Academy", "Bastau","State and History of Law”, “Constitutionalist" and others. In total, there are 9 clubs.

According to scientific, educational and methodical work, the Department is the leader in the ranking of departments of the University. Numerous fundamental and grant research conducted by the Department teaching staff allow to actively involve undergraduates and doctoral PhD students in scientific work.

 

Department of Theory and History of state and Law, Constitutional and Administrative Law maintains close ties with Peoples' Friendship University of Russia (Moscow), Kyrgyz State National University, Tashkent State University and Lomonosov Moscow State University, University of Tartu, Dagestan State University (Russia). The Department maintains scientific contacts with the SOROS Foundation - Kazakhstan, the European TACIS Programme and promotes cooperation with Central European University (Budapest, Hungary).
